Terms of Service

These Terms of Service govern your use of nudg-e.com ("nudg-e", "we", "us"), an SMS-based accountability service. By creating an account or using the service, you agree to these Terms.

Your account

You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
You may not create an account on behalf of another person without their consent.

Acceptable use

Use nudg-e only for lawful, personal accountability purposes.
Do not use the service to harass, threaten, or spam anyone.
Do not use nudg-e for marketing, political, or commercial mass messaging.
Do not attempt to reverse engineer, scrape, or interfere with the service.

Accountability partners — important

You may add accountability partners by providing their phone number. By doing so, you represent that:

The person is aware that you are adding them and has agreed to receive SMS from nudg-e.
You have a personal, non-commercial relationship with that person.
You will not add phone numbers you found publicly or from lists.

We send partners a one-time confirmation SMS and will only send further messages after they reply YES. Regardless, adding a phone number without the person's knowledge is a violation of these Terms and may result in account termination.

SMS terms

By providing a phone number and checking the consent box at signup (or by texting our number first), you agree to receive recurring SMS/MMS messages from nudg-e. Message frequency varies based on tasks you create. Message and data rates may apply from your carrier.

You can opt out at any time by replying STOP to any message. Reply HELP for support.

Your content

Task titles, descriptions, and partner names you enter are your content. You retain ownership. You grant us a limited license to display, transmit, and process your content strictly as needed to operate the service.

Service availability

nudg-e is provided "as is" without warranty of any kind. We do not guarantee that messages will always be delivered, that the service will be uninterrupted, or that scheduled nudges will fire exactly on time. Carrier delays, outages, and unforeseen issues can affect SMS delivery. Do not rely on nudg-e for medical, legal, safety, or other critical reminders.

Fees

The service is currently free. If we introduce paid plans, we will notify you in advance and you can choose not to upgrade.

Termination

You may delete your account at any time by emailing liam@nudg-e.com or texting STOP to stop all SMS.
We may suspend or terminate accounts that violate these Terms, especially adding phone numbers without consent or using nudg-e for unwanted messaging.

Liability

To the fullest extent permitted by law, nudg-e and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the past 12 months (which, on the free plan, is zero).

Changes to these terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent change. Continued use of the service after a change constitutes acceptance of the new Terms. For material changes, we will notify you via email or SMS.
